About Dwellio and these Terms

Dwellio provides tools to discover, research, and engage with property listings, agencies, and agents. By accessing or using the site, you accept these Terms of Service on behalf of yourself or the entity you represent. If you do not agree, do not use the services.

The services are intended for individuals and organizations interested in property discovery, agency participation, and advertising placements related to real estate.

Eligibility

You must be legally capable of entering into these terms and comply with all applicable laws when using Dwellio. Use of the services is non-exclusive, non-transferable, and intended for lawful purposes only.

Dwellio may offer additional features for agencies, agents, or advertisers. Eligibility for those features may require verification of your professional role, association with an agency, or compliance with industry rules.

Accounts and security

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify Dwellio immediately of any unauthorized use or security concern.

Dwellio may enable agencies or team administrators to manage user access. If you are granted access by an agency, you confirm you are authorized to act on its behalf.

Listings and content accuracy

Dwellio aggregates and hosts listing information provided by property owners, agents, agencies, advertisers, and third-party sources. We do not guarantee the accuracy, completeness, availability, or timeliness of listings or related data.

Dwellio does not provide real estate, legal, financial, or other professional advice. Any decisions you make based on listings or content are your responsibility. Always validate details with the relevant agent, agency, or professional advisor.

Advertising and partner obligations

Agencies, agents, and advertisers who upload or manage listings, creatives, or campaigns represent and warrant that they have the rights to submit that content and that it is accurate, lawful, and non-infringing. You agree to comply with applicable property, advertising, privacy, and consumer laws, and any industry guidelines relevant to your campaigns.

Advertising placements and promotional inventory are subject to availability and approval. Dwellio may refuse, remove, or require changes to creatives or listings that do not align with our policies. Unless explicitly agreed in writing, Dwellio does not guarantee impressions, leads, conversions, or other performance outcomes.

Acceptable use

When using Dwellio, you agree not to:

• Scrape, crawl, or harvest data without permission or in violation of applicable laws.
• Interfere with or disrupt the service, including via malware, bots, or unauthorized automation.
• Misrepresent your identity, role, or affiliation, or engage in fraud or misleading practices.
• Upload or share unlawful, defamatory, infringing, or deceptive content.
• Send spam, solicitations, or unsolicited commercial messages through Dwellio tools.
• Reverse engineer, decompile, or attempt to access non-public areas of the service.

Intellectual property

Dwellio and its licensors own all rights in the platform, including the Dwellio name, logos, design elements, and software. You receive a limited, non-exclusive, revocable right to access and use the services as provided.

You retain ownership of content you submit. By providing content, you grant Dwellio a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content for the purposes of operating and improving the services and promoting listings or campaigns.

Third-party services and privacy

Dwellio may integrate mapping providers, payment processors, analytics services, or other third-party tools. Those services may have their own terms and privacy practices. Your use of third-party services is governed by their respective agreements.

Dwellio's handling of personal information is described in the privacy information made available on our site, including any published privacy policy. Please review it to understand how data is collected and used.

Dwellio may present links to external sites for additional details, resources, or partner offers. We are not responsible for the content or practices of third-party sites.

Disclaimers

The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Dwellio disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability and indemnity

To the extent permitted by law, Dwellio will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities. Our total liability for any claim related to the services is limited to the greater of the amounts you paid to Dwellio for the service giving rise to the claim or an aggregate cap of AUD $100.

You agree to indemnify and hold harmless Dwellio, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the services, your content, or your violation of these terms or applicable laws.

These terms are governed by the laws of the jurisdiction in which Dwellio operates, without regard to conflict of law principles.

Termination

Dwellio may suspend or terminate your access at any time for conduct that violates these terms, harms the services, or is required by law. You may stop using the services at any time. Certain provisions that by their nature should survive termination will continue to apply, including ownership, disclaimers, limitations of liability, and indemnity.

Changes to these terms

We may update these terms from time to time to reflect changes to our services or legal requirements. If updates are material, we will provide notice through the site or by other reasonable means. Your continued use of the services after an update signifies acceptance of the revised terms.
